Judgment
On a mention being made by the learned counsel for the applicant, this case has been taken up today.
Heard the learned counsels for the parties.
Learned counsel for the applicant has deposited two demand drafts bearing D.D. No. 438726 dated 05.05.2026 for Rs. 2.00 lacs and D.D. No. 438727 dated 05.05.2026 for Rs. 10.00 lacs before this court today. Let the said amount be kept in the form of FDR in the nationalized Bank for a period of one year in auto renewal scheme.
Learned counsel for the applicant submits that an interim application has been filed in the pending S.A. before the Tribunal below for restraining the bank from taking possession of the property in question, which is fixed today i.e. 06.05.2026, but there is no Presiding Officer in the Tribunal below, therefore, no relief could be obtained from there. Learned counsel prays that as the supervisory jurisdiction of this Appellate Tribunal is over the Tribunals below, therefore, the interest of the applicant may be protected, which has been opposed by the counsel for the respondent-bank.
Be that as it may, the present misc. application stands disposed of with direction upon the Tribunal below to consider and decide the aforesaid application filed by the applicant in accordance with law most expeditiously preferably within 10 days after taking the charge of DRT, Ranchi, as it has been intimated that the Ministry shall either transfer the jurisdiction or give the charge of the DRT, Ranchi shortly to some other DRT under jurisdiction of this Appellate Tribunal. Till then, all the parties concerned are directed to maintain the status quo qua the property in question as it exists today.
