Prafulla C. Pant, J.—Mr. Shivanand Bhatt, Brief Holder with Mr. M.A. Khan, Brief Holder, present for the State. This is urgency application No. 791 of 2012, moved on behalf of the appellants for disposal of the bail application moved in the criminal appeal. The appeal was admitted by this Court on 31.1.2012. Learned counsel for the appellants argued that co-accused Bhura, Dilshad, Mansoor, Akbar Suleman, Shabbir, Naseem, Usman, Imran, Mangta @ Naushad, Bhura S/o Akhtar and Sultan have already granted bail. It is further contended that role of all the accused including appellants is same. It is also pointed out that appellants were also on bail during the trial. The conviction has been recorded by the trial court against the present appellants and other co-accused under Sections 147, 148, 452 read with 149 IPC, 436 read with 149 IPC, 504, 506 IPC. In the above circumstances without expressing any opinion as to final merits of the appeal, the bail application No. 71 of 2012 is allowed. Let appellants Yaseen and Jaan Alam @ Kanti be released on bail on executing personal bond by each one of them, and furnishing two sureties for each one of them each of the like amount to the satisfaction of the Chief Judicial Magistrate, Hardwar. (Urgency application No. 791 of 2012, stands disposed of).
