Rule. Learned Additional Public Prosecutor waives service of Rule on behalf of the Respondent – State.

The present application is filed by applicant for enlarging him on parole leave for a period of 30 days on the ground of taking care of his minor children as the wife of the prisoner – convict has passed away.

Considering the averments made in the application and perusing the jail remarks, it reveals that the jail conduct of the applicant is good. On earlier occasions, he was granted leaves, he surrendered before the jail authority in time. The applicant – accused has undergone more than one year.

The present application is partly allowed. The applicant is ordered to be released on parole leave for a period of Seven days from the date of his actual release, upon his furnishing a personal bond of Rs.15,000/- (Rupees Fifteen Thousand only) with a surety of the like amount to the satisfaction of the jail authority on usual terms and conditions, and on a further condition that he shall surrender before the Jail authorities on expiry of the parole period. Rule is made absolute to the aforesaid extent.
