Rule. Learned Additional Public Prosecutor waives service of Rule on behalf of the Respondent – State.
The present application is filed by applicant through his wife by party-in-person for enlarging him on parole leave for a period of 30 days on the medical ground of illness of the daughter of the prisoner.
Considering the averments made in the application and perusing the jail remarks, it reveals that on earlier occasions he was granted leaves, he surrendered before the jail authority in time except on some occasion. The applicant – accused has undergone more than two years.
The present application is partly allowed. The applicant is ordered to be released on parole leave for a period of Seven days from the date of his actual release, upon his furnishing a personal bond of Rs.15,000/- (Rupees Fifteen Thousand only) with a surety of the like amount to the satisfaction of the jail authority on usual terms and conditions. The applicant shall mark his presence once before the closest police station, and on a further condition that he shall surrender before the Jail authorities on expiry of the parole period. Rule is made absolute to the aforesaid extent.
