The present Application has been filed for regular bail under Section 8 read with Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short, “Act, 1985”) in connection with the Case Crime No.2 of 2025, registered at police station Bhowali, District Nainital.

As per the First Information Report, the police party apprehended the applicant and recovered 374 grams of charas from the possession of the present applicant on 02.02.2025.

Heard Mrs. Sheetal Selwal, learned counsel for the applicant and Mr. Pankaj Joshi, learned AGA for the State.

Mrs. Sheetal Selwal, Advocate, has contended that the applicant has been falsely implicated in the present matter. The alleged contraband was not recovered from his possession. The alleged recovered contraband “Charas” was less than the commercial quantity prescribed by the notification under the Act, 1985. Applicant does not have any criminal antecedents. He is a perm anent resident of District Almora, therefore, there is no likelihood of his absconding.

Mr. Pankaj Joshi, learned AGA for the State, has opposed the bail application orally.

Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.

The Bail Application is allowed.

Let the applicant – Virender Singh be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
