Judgment
Alok Kumar Verma, J
The present Application has been filed for regular bail in connect ion with Case Crime No. 395 of 2024, registered at police station Ramnagar, District Nainital.
The applicant is in judicial custody under Sect ion 8/20/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
As per the First Information Report, the Police party apprehended the applicant on 30.12.2024 and recovered 352 gram of Charas from the car of the applicant
Heard Mr. R.K. Rawat, learned counsel for the applicant and Mr. Akshay Latwal, learned Brief Holder for the State.
Mr. R.K. Rawat, Advocate has contended that the applicant has been falsely implicated in the present matter. The alleged contraband was not recovered from his possession. The alleged recovered contraband is much below commercial quantity. Applicant is not a previous convict and he is a permanent resident of District Nainital, therefore, there is no chance of his absconding.
Mr. Akshay Latwal, learned Brief Holder, has opposed the bail application orally.
Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.
The Bail Application is allowed.
Let the applicant – Ganesh Prasad be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
