The present Application has been filed for regular bail under Section 8 read with Sect ion 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short, “Act, 1985”) in the case bearing FIR No. 8 of 2025, registered at police station Kempty, District Tehri Garhwal.

As per the First Information Report, on suspicion, the police party apprehended the applicant on 08.01.2025. He was searched. The applicant was found in possession of the contraband “Charas” weighing 502 grams.

Heard Mr. Rajat Mittal, learned counsel for the applicant and Mr. Pankaj Joshi, learned AGA for the State.

Mr. Rajat Mittal, Advocate, has contended that the applicant is an innocent person. He has been falsely implicated in the present matter. The alleged contraband was not recovered from his possession. The alleged recovered contraband was less than the commercial quantity prescribed by the notification under the Act, 1985. Applicant does not have any criminal antecedents. He is a permanent resident of District Dehradun, therefore, there is no chance of his absconding.

Mr. Pankaj Joshi, learned AGA for the State, has opposed the bail application orally.

Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.

The Bail Application is allowed.

Let the applicant – Sardar Singh be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
