This Contempt petition has been filed by the applicant against the respondents/contemnors for willful and deliberate disobedience of order dated 19.09.2025 passed by this Tribunal in Original Application No.200/766/2016.
Heard the counsel for the parties.
There was a limited direction of the Tribunal to consider the case of the applicant to conduct a departmental enquiry before imposing the punishment of ‘dies non’. We find that the substantive compliance of order has been done since the competent authority held the inquiry on 30.04.2026 wherein the applicant was given an opportunity to produce all the documents and evidence in relation to his caste certificate. Based on the inquiry report and representation of the applicant, the disciplinary authority has come to a conclusion that non communication of the order of appellate authority was attributable to the departmental authorities and not to the applicant. Therefore, it was decided to grant the pensionary benefits to the applicant for the period from 02.04.2004 to 22.07.2015. However, the disciplinary authority has decided to continue the said period as ‘dies non’ for all other purposes.
In light of the orders passed on 05.06.2026, we are of the considered view that the order of this Tribunal has been complied with by respondents/contemnors. This contempt petition is hereby closed. Notices issued to the respondents/contemnors are discharged.
