Judgment
Application is registered based on a complaint received by Post.
In compliance of order dated 25.05.2023 report of the Joint Committee has been filed vide email dated 25.08.2023.
I.A No. 728/2023 has been filed by M/s M.P. Traders, M/s Elite Mining Corporation and M/s Kawaljeet Singh Batra for grant of permission to intervene and impleading them as necessary party and/or grant permission to file reply/written submissions. I.A No. 729/2023 has been filed by the above said applicants for extension of interim order dated 25.05.2023 till report is filed by the Joint Committee and considered by this Tribunal and directing the Government Authorities to grant/consider grant of permissions for construction of temporary bridges in accordance with law.
We have heard the learned Counsel for the interim applicants as well as learned Counsel for other respondents.
In view of the facts and circumstances and the averments made by the interim applicants as to the orders to be passed in the case to be likely to affect them, I.A No. 728/2023 is allowed and the applicants are granted permission to intervene and are impleaded as respondents no. 8 and 9 but without permission to file reply as filing of any such reply is not essential.
Since Report of the Joint Committee has been filed and the questions involved have to be considered on the basis of recommendations, I.A No. 729/2023 with the prayer “(i) allow the present application and extend he time period permitting construction of temporary bridges till report is filed and considered in terms of interim order dated 25.05.2023 passed by this Hon’ble Tribuna, and (ii) Direct the government Authorities to grant/consider the permissions for construction of temporary bridges in accordance with law…..” has become infructuous and is disposed of accordingly.
The case is adjourned to 05.10.2023 the date already fixed for further consideration.
