Judgment
In this Original Application, the issue raised relates to use of large number of horses in the small area of Kufri affecting natural vegetation, local ecology and causing damage to the environment. The joint Committee appointed by the Tribunal had submitted the action taken report indicating the situation as also suggesting remedial measures.
In terms of the direction of the Tribunal, State of Himachal Pradesh has filed the action plan on 08.04.2024. Learned Counsel for the applicant seeks time to examine the same and file objection/suggestions in response thereto.
I.A. No. 166/2024 has been filed by as many as 8 horse groups seeking impleadment in the O.A. Learned Counsel for the applicant in the IA is directed to supply a copy thereof to all the concerned parties and it will be open to all the concerned parties to file response thereto, if required.
I.A. No. 140/2024 has been filed by the Chief Conservator of Forests, Shimla Forest Circle, Shimla seeking extension of time to deposit the cost in terms of the order dated 12.02.2024. On 12.02.2024, the Tribunal had accepted the action taken report filed belatedly in pursuance to the earlier directions subject to deposit of cost of Rs. 10,000 before the Registrar General of the Tribunal within one week. Learned Counsel for the applicant in I.A. No. 140/2024 has submitted that the cost will now be deposited within one week.
Having regard to the circumstances disclosed, we allow the prayer made in I.A. No. 140/2024 and extent the time for deposit the cost in terms of the order dated 12.02.2024 for one week from today.
Mr. Manish Rampal, DFO, Theog is present by virtual mode in terms of the previous order. He is directed to remain present virtual on the next date also to assist the Tribunal.
