This original application was registered under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) pursuant to a letter petition dated 26.11.2021 received from Sultanpuri Resident Welfare Association, B-2/444, Sultanpuri, Delhi– 110086 complaining that there are three hot mix plants operating on the bridge of drains at Mangolpuri – Sultanpuri. The plants are operating by burning rubber, old tyre-tubes, used oil from industries and chemical waste which is emitting polluted air causing huge air pollution and health hazards to residents in the area.

Looking to the allegations made in the petition, we found it appropriate to obtain a factual report and hence, by order dated 03.01.2023, we constituted a Joint Committee comprising DPCC and concerned District Magistrate with the direction to visit the site, collect relevant information and submit a factual report.

Pursuant to above order, Joint Committee has filed a factual report dated 24.02.2023 and it has been stated therein that the Committee visited the site and did not find any such activities like functioning of Hot Mix  Plants,  construction  activities  etc.  near  all  seven  bridges  around Sultanpuri and Mangolpuri. The findings recorded in para 2 of the report reads as under:-

“2. That in compliance to the order passed by this Hon’ble Tribunal inspection of the bridges were carried out on 15.02.2023 by the joint Committee consisting of Revenue Department and DPCC. The joint team has visited all seven bridges around Sultan Puri and Mangol Puri and team also taken photographs with time and date stamped, geo-tagging etc. During inspection, no hot mix plant/ construction observed in any of the bridge. Copy of the inspection report and photographs are collectively enclosed herewith as Annexure R-1 (Colly).”

It is also said that a similar complaint was made by Vijay Kumar (this very applicant) to DPCC, received on 24.11.2021 which was forwarded to Commissioner, MCD-North vide letter dated 10.12.2021.

Since, the activities as alleged in the petition have not been found undergoing at the places mentioned in the said letter petition, considering the report of Joint Committee, we find that no further order is required in this matter.

Accordingly, the application is disposed of.
