Judgment
ORDER:
The Criminal Petition has been filed under Section 483(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), seeking relaxation of the conditions imposed on the petitioner/Accused No.2 vide order dated 14.07.2026 in Crl.M.P.No.627 of 2026 in Crime No.84 of 2025 of Ananthapuramu Rural Police Station, passed by the learned IV Additional District and Sessions Judge-cum-Special Judge for Trial of Offences against Women, Ananthapuramu.
Mr. M. Karibasaiah, learned counsel for the petitioner, submits that the petitioner has been regularly complying with the conditions imposed by the learned Trial Court, but the charge sheet has not yet been filed.
Mr. A. Sai Rohith, learned Assistant Public Prosecutor, also confirms the same.
Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.
Considering the facts and circumstances of the case, this Court is inclined to relax the following conditions imposed on the petitioner/Accused No.2 vide order dated 14.07.2026 in Crl.M.P.No.627 of 2026 in Crime No.84 of 2025 of Ananthapuramu Rural Police Station, passed by the learned IV Additional District and Sessions Judge-cum-Special Judge for Trial of Offences against Women, Ananthapuramu, namely, the condition requiring him to appear before the Investigating Officer on every Sunday, Tuesday and Thursday between 10.00 A.M. and 12.00 Noon until filing of the charge sheet, and the condition restraining him from leaving the State of Andhra Pradesh without prior permission of the concerned Court until filing of the charge sheet. Accordingly, the aforesaid conditions are hereby relaxed.
However, as the charge sheet has not yet been filed, the petitioner shall appear before the Investigating Officer as and when required and shall cooperate with the Investigating Officer for the effective completion of the investigation.
The remaining conditions imposed by the learned Trial Court in the original order shall remain in force and shall be duly complied with by the petitioner/Accused No.2.
Accordingly, the Criminal Petition is disposed of.
As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
