Judgment
In this writ petition, following reliefs have been prayed for, which reads as follows:-
“for the issuance of an appropriate Writ/ writs/ order/ orders/ direction/ directions commanding upon the respondents-to pay Rs 1,16,360/- (Rs one lakh sixteen thousand eight hundred sixty only) for which the work order issued by the respondent no.3 vide letter no.1237 dated 14.07.2013 for the construction of hundred mega tone capacity godown at Hazaribag agriculture department premises, the total cost for the above work was worth Rs 16,69,498/- (sixteen lakhs sixty nine thousand four hundred ninety eight only) out of that only Rs 1,16,368/- is pending before the respondent no.3 since 2016.”
Heard learned counsel representing the petitioner and learned counsel representing the respondents.
This writ petition was filed by the original petitioner claiming admitted contractual dues.
At para-13 of the counter affidavit filed on behalf of respondent No.3 - The Executive Engineer, Building Division, Hazaribagh, it has been admitted that the balance amount now remaining is Rs.1,16,360/-, which will be made available after allotment of the demanded fund by the District Agriculture Officer, Hazarbagh. Para-13 of the said counter affidavit is quoted as hereunder:-
“13.That it is humbly stated and submitted that as the fund/allotment is provided by the Agriculture Department, Ranchi the remaining amount Rs. 116360/- claimed by the petitioner will be made available after allotment of demanded fund by District Agriculture Officer, Hazaribagh.”
The aforesaid admission of respondent No.3 suggests that the petitioner is entitled for Rs.1,16,360/-. Once the respondent is accepting the same, it is expected that within eight weeks from today, the admitted amount will be disbursed to the petitioner, after arranging for the necessary fund.
With the aforesaid observation and direction, this writ petition stands disposed of.
