PER HON’BLE MR. PANKAJ KUMAR, MEMBER (A)

In this case relating to transfer, the applicant has sought the following reliefs:

i.

To quash the impugned transfer order dated 30.06.2026 and order dated 28.07.2026 (contained as Annexure No. A-1 & A-2 to this OA), with all consequential benefits.

ii.

To allow the applicant to continue at present place of posting and pay him salary accordingly:

iii.

Any other relief, which this Hon'ble Tribunal may deem fit, just and proper under the circumstances of the case, may also be passed.

iv.

Cost of the present case.

Heard learned counsel for the applicant, learned counsel for the respondents and perused the records.

Learned counsel for the applicant submits that the ends of justice would be served if liberty is granted to the applicant to prefer a fresh representation to the respondents and direction is given by this Tribunal to the respondents/competent authority to consider and dispose of representation of the applicant so preferred in light of the DoP&T OMs attached as Annexure A-9 (page 25 to 31), by way of reasoned and speaking order within a stipulated period of time.

Learned counsel for the respondents opposes the aforesaid prayer; however, submits that, if so directed, at least two months’ time may be given for disposal of such representation.

Keeping in view the innocuous prayer made by the applicant, this O.A. is disposed of, without going into the merits of the case, granting liberty to the applicant to prefer a fresh representation to the respondents within two weeks from the date of receipt of certified copy of this order and the respondents/competent authority are directed to consider and decide the applicant’s representation so preferred in light of the DoP&T OMs attached as Annexure A-9 (page 25 to 31) of this OA, by way of reasoned and speaking order to be communicated to the applicant within two months from the date of receipt of his representation.

Associated MAs also stand disposed of.

Parties shall bear their own costs.
