O R D E R

Heard the learned counsel for the applicant, learned counsel for the respondents and perused the records.

Through this Original Application, applicant has prayed for the following relief(s):

“I. To quash /set aside the impugned transfer order dated 31.08.2026 passed by the respondents, whereby petitioner was transferred from PM SHRI KENDRIYA VIDYALAY CRPF BIJNOUR LUCKNOW –II TO PM SHRI KENDRIYA VIDYALAY BEHRAMPORE (West Bengal) in accordance with paragraph 2(i) (A) (b) (ii) of part-1-A of the KVS Transfer Policy as contained in Annexure No. A-1 to this original application.

II. Issue a direction to the opposite party no. 3 to consider and take a decision upon the representation dated 27.08.2026 of the Applicant within a short reasonable period to be prescribed by this Hon’ble Tribunal in the interest of justice.

III. To pass any other order or direction which the Hon’ble Tribunal may deem just and proper under the circumstances of the case as also in the interest of justice.

IV. Allow this original application with costs.”

Learned counsel for the applicant submitted that the instant O.A. may be disposed of as applicant is only seeking decision on the representations preferred by him and ends of justice would be served if a direction is given by this Tribunal to the respondents/competent authority to consider and dispose of the pending representation of the applicant dated 03.09.2026, (Annexure No. A-18 [page 48-54) to this O.A. by way of reasoned and speaking order within a stipulated period of time. Further prayed that till disposal of the representation, some interim protection may be granted to the applicant.

Learned counsel for the respondents orally opposed, however, submitted that in case the applicant’s representations are directed to be decided in the manner suggested then sufficient time may be allowed for the same.

In view of the above submission, respondents / competent authority are directed to consider and decide the representation of the applicant dated 03.09.2026, (Annexure No. A-18 [page 48-54) to this O.A. and pass a reasoned and speaking order as per law within a period of four weeks from the date of receipt of certified copy of this order under intimation to the applicant forthwith. Till the decision taken on the representation, no coercive action shall be taken against the applicant.

Merits of the case has not been touched upon by the Tribunal.

The OA is disposed of accordingly.

There is no order as to costs.
