Miscellaneous Application No. 1333/2026
The present Miscellaneous Application filed by the applicants under Rule 4(5) of the Central Administrative Tribunal (Procedure) Rules, 1987, seeking permission to join and pursue the Original Application (O.A.) collectively, is allowed.
Original Application No. 1271/2026
This is an Original Application filed by the applicants under Section-19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-
i.allow the instant Original Application;
ii.quash /set aside condition (v) of Govt. Order No. 229-F dated 17.10.2014 issued by the Govt. thereby upgrading the grade attached to the posts of Head Constable and A.S.I from 4300-5900 to 4500-7000 (5200-20200+GP 2800) and 4500-7000 to 5000-8000 (9300-34800+GP 4200) to the extent pay grades have been upgraded prospectively only;
iii.direct the respondents to upgrade the pay scales attached to the post of Head Constables and Assistant Sub Inspector of Police from 4300-5900 to 4500-7000 (5200-20200+ G.P. 2800) and 4500-7000 to 5000-8000 (9300-34800+ G.P 4200) retrospectively w.e.f. 01.01.1996 i.e. the date since when anomaly in the grade came into being;
iv.direct the respondents to place before this Hon’ble Court the recommendations of the Pay Anomaly Committee constituted vide Govt. Order No. 138-GAD of 2009 dated 08.10.2009 and revived vide Govt. Order no. 67-GAD of 2012 dated 16.01.2012;
v.direct the respondents to grant the revised pay scale retrospectively with all consequential benefits including monetary benefits;
vi.direct the respondents to issue revised last pay certificate in favour of the applicants after the revision of their pay scales and consequently the revision of pensionary benefits of the applicants;
ANY other order or direction which this Hon’ble Court may deem fit or proper in the facts and circumstances of the case.”
Learned counsel for the applicants submitted that the applicants would be satisfied if this Original Application is disposed of with the directions to the respondents to consider the case of the applicants keeping in view the order passed in TA No. 6839, 6757, 6761 of 2020, titled Ajit Singh and Ors. Vs. UT of J&K and connected matters, dated 10.10.2025.
Heard learned counsel on both sides.
Accordingly, the Original Application stands disposed of, at the admission stage without entering into the merits, with a direction to the respondents to examine the case of the applicants in the light of the order dated 10.10.2025, passed in TA No. 6839, 6757, 6761 of 2020, titled Ajit Singh and Ors. Vs. UT of J&K and connected matters. In the event that the applicants' case is found to be similarly situated and the equivalence is established, the respondents shall extend to the applicants the same benefits as were granted to the applicants in the aforesaid case. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. No order as to costs.
Ordered accordingly.
