O R D E R

Miscellaneous Application No. 1335/2026

The present Miscellaneous Application filed by the applicants under Rule 4(5) of the Central Administrative Tribunal (Procedure) Rules, 1987, seeking permission to join and pursue the Original Application (O.A.) collectively, is allowed.

Original Application No. 1273/2026

This is an Original Application filed by the applicants under Section-19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-

i.

Direct Respondent No. 2 (Higher Education Department, UT of Ladakh) to treat the applicants as government employees governed by the Old Pension Scheme, and convert them from NPS to Old Pension Scheme, in terms of and in the spirit of the dated 02-06-2026 passed by this Hon'ble Tribunal in in T.A No. 724/2022 within four weeks from the date of order on the present application;

ii.

Direct the Respondents to grant to the Applicants all consequential benefits flowing from the Old Pension Scheme, including qualifying service benefits, pensionary computation under the old rules, family pension, gratuity, death-cum-retirement gratuity, service gratuity and all other retiral benefits associated with the Old Pension Scheme;

iii.

Direct the Respondents to ensure that the Applicants are not placed at any disadvantage in terms of seniority, pay, grade pay, increments or promotional opportunities vis-a-vis their counterparts in UT of J&K.

Prayer for the grant of any other interim or final relief as may be deemed appropriate in the facts and circumstances of the case in favour of the applicant.”

Through the medium of this original application, the applicants are seeking benefit of judgment passed in TA No. 724/2022 pronounced on 02.06.2026.

Learned counsel for the applicants submits that the applicants would be satisfied if this OA is disposed of with the direction to the respondents to treat this OA as representation of the applicant for considering their cases in the light of judgment passed in case titled “Wahied Balwan and Ors. v. State of J&K and Anr. (TA No. 724/2022)” and deciding it within a stipulated timeframe.

Having regard to the limited prayer made on behalf of the applicants, this Original Application is disposed of at the admission stage, with a direction to the respondents to treat this OA as a formal representation of the applicants and decide the same in the light of aforementioned judgment, dated 02.06.2026.

The respondents shall pass a reasoned and speaking order on the aforesaid representation within a period of four weeks from the date of receipt of a certified copy of this order.

With the aforesaid directions, the Original Application stands disposed of. No order as to costs.
