Judgment
O R D E R
Shri Ram Mohan Johri, Administrative Member
This is an Original Application filed by the applicants under Section-19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-
“i.Allow this Original Application of the applicants;
ii.Direct the Respondents to consider and decide the Applicants' legitimate claim for regularization, along with all consequential service and monetary benefits, in the light of the settled position of law laid down by the Hon'ble Division Bench vide judgment dated 08-08-2025 passed in WP (C) No. 2151/2025 titled U.T. of J&K & Örs Vs Kanta Devi and WP (C) No:-2159/2025 titled U.T. of J&K & Ors Vs Bittu & WP (C) No. 2161/2025 titled U.T. of J&K & Ors Vs Kulvinder and further affirmed by the Hon'ble Supreme Court of India in SLP (Civil) Diary No:-11445/2026, SLP (Civil) Diary No:-28738/2026 and SLP (Civil) Diary No:-25213/2026 respectively and consequently extend to the Applicants the same benefits as are admissible in terms of the aforesaid judgments, in accordance with law, within a reasonable period of time;
iii.Direct the respondents to issue formal orders regularizing the services of the applicants under the Jammu & Kashmir Civil Services (Special Provision) Act, 2010 with effect from the appointed day, i.e., 29.04.2010, in terms of the law laid down by the Hon'ble High Court of Jammu & Kashmir and Ladakh, and the Hon'ble Supreme Court of India;
iv.Grant all consequential service benefits, including pay fixation, annual increments, seniority and continuity of service;
v.Release the arrears arising out of such regularization together with all consequential monetary benefits;
vi.Grant interest at an appropriate rate on the delayed payment of retiral and monetary benefits, in accordance with law.”
Through the medium of this original application, the applicants are seeking benefit of judgment dated 08.08.2025, passed by the Hon’ble High Court of J&K and Ladakh in WP (C) No. 2151/2025 titled U.T. of J&K & Örs Vs Kanta Devi and WP (C) No. 2159/2025 titled U.T. of J&K & Ors Vs Bittu & WP (C) No. 2161/2025 titled U.T. of J&K & Ors Vs Kulvinder and further affirmed by the Hon'ble Supreme Court of India in SLP (Civil) Diary No:-11445/2026, SLP (Civil) Diary No. 28738/2026 and SLP (Civil) Diary No. 25213/2026 respectively.
Learned counsel for the applicants submits that the applicants would be satisfied if this OA is disposed of with the direction to the respondents to treat this OA as representation of the applicant for considering their cases in the light of aforementioned judgments and deciding it within a stipulated timeframe.
Having regard to the limited prayer made on behalf of the applicants, this Original Application is disposed of at the admission stage, with a direction to the respondents to treat this OA as a formal representation of the applicants and decide the same in the light of aforementioned judgments and pass a reasoned and speaking order within a period of four weeks from the date of receipt of a certified copy of this order.
With the aforesaid directions, the Original Application stands disposed of. No order as to costs. MA No. 1394/2026, for joint together is allowed.
