Judgment
IA-5276/2021:-
This is an application filed for seeking clarification on the appointment of the third Member to decide IA-1628/2020 & IA1746/2020. Reliefs sought by applicant are as under:-
"(i) Clarify the appointment of the third member for deciding the IA-1628/2020 and IA-1746/2020 in terms of the order dated 07th January 2021 passed by the Hon'ble NCLT, Mumbai Bench No. 5 and the order dated 29.10.2021 in view of the e-mail dated 21.10.2021, for expeditious hearing; and
(ii) Pass such other or further order(s) or relief(s) which this Honble Tribunal any deem fit and proper in the facts and circumstances of the case."
Earlier by administrative order dated 23.09.2021 Sh. V. Subba Rao Hari, Member (Judicial) was designated as the third member to hear the case and it was published by the Registry of the Tribunal. Thereafter in Transfer Petition (IBC)-63(PB)/2021 filed by UTI Structured Debt Opportunities Fund-I, then Hon'ble Actg. President pronounced a judicial order on 29.10.2021 directing Dr. P.S.N. Prasad, Member (Judicial) to hear and adjudicate the matter as a third member. The order was passed in terms of Rule 16(d) of NCLT Rules, 2016 in TP (IBC)-63(PB)/2021 will have to be acted upon as it is an order passed in terms of the provisions of the Act and Rules and therefore Dr. P.S.N. Prasad, Member (Judicial) will hear the matter as a third member.
Registry is directed to take appropriate steps for early hearing for the matter.
