Judgment
Learned counsel for the appellant and learned counsel for the respondent are present.
In terms of the order dated 02.09.2021 learned counsel for the IRP was directed to file hard copy of the order passed by the Hon'ble Supreme Court of India in Civil Appeal No.4804/2021 within one week and the matter was directed to be listed on 14.9.2021. Hence the matter is listed today.
Learned counsel for the IRP has filed the copy of the order of the Hon'ble Supreme Court passed in Civil Appeal Dy. No.4804/2021. The order is as under:
"IA Nos 1628/2020 and 1746/2020 filed in Company Petition No.3434 of 2019 is pending consideration before the adjudicating authority. We are informed that the IAs, are being heard and are listed for further hearing on 17.03.2021. The NCLT is directed to complete the hearing and pass orders at the earliest.
List this appeal after three works."
In view of the Hon'ble Supreme Court orders, the NCLT will hear and dispose of the matter.
Learned counsel for the appellant is permitted to withdraw the appeal.
The appeal is accordingly dismissed as withdrawn.
Let a copy of the order be sent to the NCLT, Mumbai Bench, Mumbai immediately.
