Judgment
ORDER
Mohd Iftekhar Farooqui, learned counsel appearing for the applicant and Shri Vidyapati Tripathi, learned counsel appearing for the respondents, are present and heard.
At the outset, learned counsel for the applicant submitted that the applicant will be satisfied if the O.A. is disposed of at this stage itself directing the competent authority amongst the respondents to decide the pending representation dated 19.02.2021 (Annexure No-A-1) as well as the reminder dated 10.05.2021 (Annexure No-A-4) moved by the applicant by passing a reasoned and speaking order thereon in a time bound manner.
Learned counsel for the respondents opposed the prayer made by learned counsel for the applicant.
I have considered the rival submissions of learned counsel appearing for the parties and perused the entire documents record.
In view of the limited prayer made by learned counsel appearing for the applicant, no useful purpose will be served in keeping this O.A. pending, therefore, without entering into the merits of this case, the O.A. is disposed of at this stage itself with a direction to the competent authority amongst the respondents to decide the pending representation dated 19.02.2021 (Annexure No-A-1) as well as the reminder dated 10.05.2021 (Annexure No-A-4) moved by the applicant by passing a reasoned and speaking order thereon, within a period of three months from the date of receipt of a certified copy of this order. In case the said representation/reminder is not in the records of the respondents, a fresh representation should be called from the applicant forthwith. Even otherwise, the applicant is at liberty to move a fresh comprehensive representation containing all the facts. Any such fresh representation should be moved by the applicant within a period of fifteen days from the date of this order/respondents’ call for a fresh representation and after such a fresh representation is moved, the competent authoring amongst the respondents shall dispose of the same within a period of three months from the date of receipt of the representation by passing a reasoned and speaking order thereon. The order so passed should be communicated to the applicant forthwith.
