Judgment
Heard the submissions made by the Learned Counsel for the Resolution Professional Mr. Pankaj Khaitan. This is an application filed by Under Rule 11 of NCLT Rules for listing and hearing of the application bearing No. CA 400/2020. In the para 4 of the present application it is stated that CoC in its meeting held on 17.12.2019 passed a resolution for liquidation of the corporate debtor and appointment of applicant as liquidator with 100% voting rights. Further followed by the resolution by CoC the applicant on 06.01.2020 filed an application under Section 33 (2) of IBC 2016 for seeking directions of the Hon'ble Tribunal to liquidate the corporate debtor vide application bearing No. CA 400/2020. The Resolution Professional has also submitted that since the application filed by him in January 2020 is not yet disposed of by the Tribunal. He moved this application for urgent hearing, as the 180 day's time for liquidation is already lapsed.
Having heard the submissions made by the Resolution Professional Mr. Pankaj Khaitan we find merit in this application and this application for urgent hearing is allowed. Let application bearing No. CA 400/2020 may be listed for hearing by the Tribunal on Friday i.e. 7th August, 2020.
