Judgment
Learned Counsel for Petitioner is ready with objections to be filed over the application filed by Respondent. Let it be filed on today itself. Copy is being said to have been exchanged but Counsel for respondent is denying it. If it has not been given to Counsel for Respondent, let it be served on today itself and if it has already been given, then need not to be re-served.
The specified jurisdiction of this Tribunal is with regard to Broadcasting Petition under a special Act i.e. TRAI Act 1997 and with regard to subject given under Section 14 and 14A of the Act, this specialized Tribunal has got jurisdiction to decide. Merely, a writ pending before High Court, with no specific injunction order, if any, will not permit this Tribunal to keep the matter pending in abeyance for wait of judgement of above writ petition. The point of Limitation is to be decided on merit along with other lis, by this Tribunal in final disposal of this Broadcasting Petition.
As pleadings and evidences are complete, only final hearing remains. Objection with regard to maintainability in view of writ pending before High Court of Delhi as well as point of limitation as has been raised, the M.A itself shall also be heard along with final hearing over this petition and this will be decided by this Tribunal.
