Learned Counsel for Respondent, is being said to be, unable to attend this Tribunal on today, because of his physical inability and a short accommodation for a week is being requested, by a proxy Counsel, which has been vehemently opposed by other side with specific contention that this averment is against the fact, rather Counsel used to appear in this Tribunal and other Courts too. Even on yesterday, this Counsel has met and seen him working.
This adjournment is deliberate one, with a frivolous applications, being very oftenly moved. There is siphoning of public money, by delaying this disposal, by any means, and this adjournment prayer is under some connivance.
M.A. No. 225 of 2023 had been filed by Counsel for Respondent, for which no objection is to be filed by Counsel for Petitioner. This application is with a prayer, for placing this Petition before Division Bench, and the prayer is based on the ground of some previous judgement/ precedent made by Division Bench of this Tribunal. Meaning thereby, a request is being made for referring previous judgement for review by Division Bench, in disposal of present Petition. It is apparently a baseless application, but any way before making final opinion, hearing of Counsel is needed in the interest of Natural justice. Hence, this application is to be heard and disposed of, along with final disposal of this Petition. Today's request is being accepted, subject to payment of cost of Rs. 5000/- (Rupees Five Thousand only).
