Judgment
Md. Jalisur Rahman appears for the petitioner-Union of India.
He submits that this writ petition arises out of the common impugned order passed by learned CAT, Circuit Bench at Ranchi dated 01.06.2017 in O.A. No. 114/2013 (R). Aggrieved proforma Respondents of the instant writ petition have approached this Court in WPS No. 4599/2017 in which this Court has been pleased to issue notice and grant interim stay. Present writ petition has also been ordered to be tagged along with that case. Respondent No. 1 herein / applicant is the contesting Respondent, as per the learned counsel for the petitioner. Rest of the private Respondents are proforma in nature, they are petitioners in WPS No. 4599/2017. Petitioners in WPS No. 4599/2017 are being represented by learned Senior Counsel Mrs. M.M. Pal. Therefore, notice may be issued upon the applicant / contesting Respondent No. 1 herein since the proforma Respondents who are writ petitioners in WPS No. 4599/2017 may enter appearance through their learned counsel on their own on the next date. Mr. Rahman undertakes to inform learned counsel for the petitioners in WPS No. 4599/2017 in the meantime. He prays for stay of the impugned order on similar lines as granted in WPS No. 4599/2017 by order dated 05.04.2020.
Let notice be issued upon the Respondent No. 1 in Stay matter (I.A. No. 10033/2017) and also on the main Memo of Application through Registered cover with A/D and Speed Post, for which requisites be filed within two weeks. Office to track the delivery of notice through Speed Post.
Let the instant writ petition appear along with WPS No. 4599/2017 on 14.09.2020, so that proforma Respondents can enter appearance through their counsel in the meantime.
In the meantime, operation of the impugned order dated 01.06.2017 passed in O.A. No. 114/2013 (R) shall remain stayed.
