The impugned order by a learned Single Judge says that the Petitioners were employed in B.I.T., Sindri and had retired from that Institution. The order further says that the State of Jharkhand should bear the financial liability of paying the arrears of difference of salary to the Petitioners in terms of the Agreement dated 30.09.2001 entered into by and between two Governments i.e. State of Bihar and State of Jharkhand.

Thereafter the order proceeds to require the State of Jharkhand to compute the amount payable.

This appeal has been filed beyond time for about 235 days. The reason given in the delay condonation application is that the State of Jharkhand took its own sweet time to take a decision whether to file this appeal or not. On this kind of ground, such long delay cannot be condoned as it would encourage the officers of the State Government to sit tight over the matters, unmindful of the limitation.

In the circumstances of the case, we reject the application for condonation of delay and accordingly reject the memo of appeal as time barred.
