Judgment
This is an application by the Government of Bombay for leave to appeal to His Majesty in Council against an order made by this Court on 22nd
April 1943, See (''43) 30 A.I.R. 1943 F.C. 1. in an appeal arising out of a habeas corpus application. It is admitted that the detenue has been
released by the Government on their own initiative, notwithstanding the dismissal of the habeas corpus application by the High Court. We are of
the opinion that there is no longer any pending matter in which leave can be granted to appeal to His Majesty in Council. Moreover, the original
petitioner, who has been released by the Government, has no longer any interest in the habeas corpus proceeding. In these circumstances, we do
not see our way to grant leave merely on the ground that the Government are disposed to question the correctness of some of the grounds on
which the order of this Court, dated 22nd April 1943, See (''43) 30 A.I.R. 1943 F.C.1. was based. The application is accordingly dismissed.
