Hon’ble Mr. Pradeep Kumar, Member (A):

The present application has been filed by the applicant against the alleged inaction of the respondents for not considering the applicant for promotion from the post of HS Grade-I to the post of Chargeman in spite of the fact that applicant is fulfilling the eligibility criteria since 2012 in terms of the extant rules on the subject.

The learned counsel for the applicant submits that the applicant has also preferred a representation dated 14.03.2018 (Annexure A-7) for redressal of his grievances and in spite of lapse of more than a year the same has not been considered and disposed of by the respondents.

Shri B. L. Wanchoo, learned counsel for the applicant further adds that even the stay order passed by this Tribunal earlier, has subsequently been modified and as on date there is no legal impediment to the respondents in considering the applicant for promotion.

Issue notice. Shri Rajeev Kumar, learned counsel, who appears on behalf of the respondents on advance service, accepts notice.

We have heard the learned counsels for the parties.

In view of the facts and circumstances, the OA is disposed of at the stage of admission itself, without going into the merits of the case, with a direction to the respondents to consider the applicant’s aforesaid representation dated 14.03.2018 and dispose of the same by passing an appropriate, reasoned and speaking order within eight weeks from the date of receipt of a copy of this order.

The applicant shall have liberty to approach the Tribunal if some grievance still subsists. No costs.
