Hon’ble Mr. R.N. Singh, Member (J):

Learned counsel for the applicant submits that the applicant is working as Driver Grade-I and he is the senior-most in the said post and eligible for promotion. However, in spite of there being a clear cut vacancy, the respondents are not convening the DPC and considering the applicant for the promotional post.

Learned counsel for the applicant further submits that for redressal of his grievance, the applicant has made various representations, including the latest one being dated 18.8.2020 (Annexure A/1).

Issue notice.

Shri R.K. Sharma, learned counsel for the respondents, who appears on advance service, accepts notice.

Shri Jangra, learned counsel for the applicant, submits that the applicant will be satisfied if the present OA is disposed of with direction to the respondent nos.2 and 3 to consider the applicant’s aforesaid representation dated 18.8.2020 (Annexure A/1) and to dispose of the same in a time bound manner.

We have considered the submissions made by learned counsel for the applicant and we are of the view, if such request of the learned counsel for the applicant is accepted at this stage, no prejudice is likely to be caused to the respondents.

In view of the aforesaid, without going into the merit of the claim of the applicant, the present OA is disposed of with direction to the respondent nos.2 and 3 to consider the applicant’s aforesaid representation dated 18.8.2020 (Annexure A/1) and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within 12 weeks of receipt of this Order.

The OA is disposed of in the aforesaid directions. No order as to costs.
