These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Berhampur Cyber P.S. Case No. 93 of 2025 corresponding to GR Case No. 3253 of 2025 pending in the file of learned SDJM, Berhampur, Ganjam for commission of offences punishable U/Ss.318(2)/ 336(2)/340/ 61(2)/111/3(5) BNS r/w Sec.65/72 of IT Act.
The background facts of the case is that the petitioners were actively involved in procuring and opening up mule bank accounts in the name of different persons by inducing them with promise of monetary benefits and after opening up the accounts, the petitioners were allegedly collecting the Pass-book, ATM cards, Cheque-books, Mobile Numbers/Sim Cards linked to the accounts and other banking credentials and handing it over to the fraudsters for carrying out online financial fraud.
Heard, Mr. Ajit Kumar Mohanty, learned counsel for the petitioner in BLAPL No.4472 of 2026; Mr. Sanjib Kumar Bhanjadeo, learned counsel for the petitioner in BLAPL No.4833 of 2026 and Mr. R.B. Mishra, learned Add. PP in these matters and perused the record.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusation sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 21.02.2026/11.03.2026 with submission of charge-sheet in the meantime and the failure of the State to disclose the financial culpability of each of the petitioners despite being sought for through learned Addl. PP and taking into account the mode and manner of implication of the present petitioners and the role as alleged against them, but the main allegation of committing online financial fraud being not directed against the present petitioners and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merit admits each of the petitioner to bail.
Hence, these two bail applications of the petitioners namely Susanta Sahu (BLAPL No.4472 of 2026) and Jyoti Ranjan @ Rohan Pradhan (BLAPL No.4833 of 2026) stand allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this judgment be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
