Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Jharsuguda Sadar PS Case No.105 of 2026 corresponding to CT Case No.382 of 2026 pending in the file of learned SDJM, Jharsuguda, for commission of offences punishable U/Ss.112(2)/317(2)/317(4)/ 317(5)/318(4)/61(2)/3(5) of BNS r/w Section 66(C) of the IT Act, on the main allegation of inducing the general public to open up mule accounts and in the process, taking such accounts from them after opening it and handing the account details together with passbook, ATM card and SIM card to co-accused Sonu Mishra for facilitating online financial fraud.
Heard, Mr. Dibya Jyoti Sahoo, learned counsel for the petitioner in BLAPL No. 4942 of 2026; Mr. Ranjan Kumar Nayak, learned counsel for the Petitioner in BLAPL No. 6284 of 2026 and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions upon perusal of record, there appears allegation against the Petitioners for inducing innocent persons to open bank accounts on false promises and procuring their accounts, passbook, ATM cards & SIM cards for handing it over to co-accused Sonu Mishra for commission of online financial fraud by paying Rs. 7000/- to Rs. 8000/- per account, but subsequently, receiving some amount from Co-accused Sonu Mishra for their role in collecting and handing over such account with details. In view of the aforesaid allegations as raised against the petitioners keeping in view the materials so placed on record and regard being had to the pre trial detention of the Petitioners in custody since 20.03.2026 with submission of charge sheet in the meantime and the main allegation of committing financial fraud being directed against co-accused Sonu Mishra and taking into account the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merits admits each of the petitioners to bail.
Hence, these two bail applications of the petitioners namely Tinku Besan (In BLAPL No.4942 of 2026) and Karunakar Singh @ Karan (In BLAPL No.6284 of 2026) stand allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
