a. None appears for the Operational Creditor in this matter.
b. A Senior Intelligence Officer, Directorate General of Goods and Service Tax Intelligence, Guwahati Zonal Unit has come up with this I.A. to seek lifting of the moratorium, since it is alleged that the Operational Creditor is in collusion with the Corporate Debtor, he preferred this application to seek undue benefit of the moratorium and the proceedings/investigation is going on against him.
c. Therefore, let a copy of the notice along with a copy of the petition be served by the Applicant upon the Operational Creditor by exploring on the three modes, Dasti service, Speed Post as well as email and affidavit of service to that effect be filed on the next date, since Operational Creditor has never entered appearance through any Counsel or any representative in the matter.
d. Last chance is given to the Operational Creditor to enter appearance in this matter failing which, on the next date, an appropriate order would be passed in the C.P. (IB)/52(KB)2023 itself.
