O R D E R
Heard both of them.
Mr. Qazi submits that the applicant was working as Conductress with the respondents in Office of Tehsil Social Welfare Officer, Kishtwar but by order dated 25.06.2022 she was directed to work in the Office of Tehsil Social Welfare Officer, Paddar.
Mr. Qazi submits that this order has been issued by an authority which is not competent to issue such transfer order of the applicant and there is no post of Conductress at Paddar and the applicant has not completed the minimum tenure of her
posting at Tehsil Office, Kisthwar.
Mr. Gupta submits that the applicant had been posted only on temporary basis and her temporary posting has been withdrawn by the respondents now.
On consideration of the above submissions of the counsels for both the parties, this O.A. is disposed of at admission stage, without expressing any opinion on merits of the case, directing Respondent No. 2 – Director, Social Welfare Department, Jammu to consider a copy of this O.A. as representation of the applicant as per provisions of relevant applicable rules and binding instructions on the subject for posting of Conductress and decide it with a reasoned order within four weeks from the date of receipt of a certified copy of this order and within one week thereafter to communicate it to the applicant.
Till the representation of the applicant is decided, the applicant should be retained at her present place of posting.
No costs.
