O R D E R
Heard both of them.
Mr. Qazi submits that the applicant is working as Veterinary Pharmacist but by order of 08.04.2022, Respondent No. 3 has transferred him on the post of Junior Veterinary Pharmacist. Respondent No. 3 is not the competent authority to transfer the applicant and only Respondent No.2 is competent.
Mr. Rajesh Thapa, D.A.G. pleads that the applicant has not yet been transferred by order under reference, he has only been temporarily attached to the new office and he has been relieved from the earlier post.
Mr. Qazi submits that he is still continuing on the post of Veterinary Pharmacist.
Considering the above submissions of the counsels for the parties, this O.A. is disposed of at admission stage, without expressing any opinion on merits of the case, directing the respondents to consider a copy of this O.A. as additional representation of the applicant and Respondent No.2 should give him personal hearing and thereafter decide it with a reasoned order within four weeks from the date of receipt of a certified copy of this order and within one week thereafter to communicate it to the applicant. In the meantime, status quo as on today about deployment of the applicant shall be maintained.
