Judgment

The brief facts of the case are that the applicant was working as Drafts Man and has been promoted to the post of Chief Drafts Man. The applicant has also been given seniority. He is asking for pay fixation vis-à-vis seniority i.e. from 1997.
On the contrary, learned counsel for the respondents submits that it is clearly barred by time. The applicant has approached after many years.
After hearing learned counsel for the parties, we are of this view that pay fixation is a recurring cause of action. At best, respondents may fix the pay of the applicant on performa basis, but the current pay can be enhanced, if he is found suitable on merit.
We are of this view, that the representation dated 02.09.2020 be disposed of with a speaking order, within a period of eight weeks from the date of receipt of copy of this order. If his grievance still subsists, he may re-approach this Tribunal.
With this observation, the OA is disposed of. Pending MA shall also stand disposed of. No costs.
