The present OA has been filed by the applicant seeking the following relief:-

“(A)

To direct the respondents to re-fix pay of the applicant from 26-04-2000 till the date of retirement (30-09-2015); and/or

To direct the respondents to issue revised PPO; and/or

(C)

To direct the respondents to make payment of all dues of pre-retiral arrears and post-retiral benefits and pension arrears; and/or

(D)

To direct the respondents to pay interest at the rate of 18 per cent per annum on the aforesaid dues on account of delayed payment Central Administrative Tribunalfrom the date of entitlement till the date of actual payment ; and/or

(E)

Any other relief or direction which this Hon'ble Tribunal deems fit and proper in view of the facts and circumstances of the case may be granted/passed in favor of the applicant and against the respondents.”

Learned counsel for the applicant submits that this is the second round of litigation. He further submits that the applicant had earlier approached this Tribunal in OA No. 2917/2024, which was decided on 29.07.2026, wherein the following order was passed:

At this Juncture, considering the limited prayer made on behalf of the applicant, the respondents are directed to consider the said representation dated 26.06.2024 and dispose of the same by passing a reasoned and speaking order preferably within four weeks from the date of receipt of certified copy of this Order.

This OA is disposed of at the admission stage itself, in the aforesaid terms. It is made clear that I have not entered into the merits of the case. The applicant shall be at liberty to agitate his grievance, if still subsists, as per law. There shall be no order as to costs.”

In pursuance of the said order, the respondents did not pass any appropriate order within the stipulated period. Being aggrieved the applicant filed CP No. 63/2026 in the aforementioned OA. Vide order dated 23.05.2025, the CP was disposed of because the respondents have passed detailed order dated 28.03.2025. Learned counsel for the applicant refers to last paragraph of the said order wherein the following has been metioned:-

“ Further the representation of respondent to re-fix the pay with effect from 26.04.2000 is under execution in consultation with finance department RZ and will be decided as per rule.”

Learned counsel for the applicant states that the respondent have not taken pro active steps for passing this speaking order and the matter is still pending with the respondents. Again the applicant submitted representation dated 20.07.2026 (Annexure A-16).

Issue notice. Mr. Aman Oberoi , learned counsel who appears for respondents on advance service, accepts notice. Learned counsel for the respondents seeks four weeks’ time to file counter reply in respect of the OA.

At this stage learned counsel for the applicant states that the applicant will be fairly satisfied if a directed may be given to the respondents to take further logical conclusion with positive intent of execution of order dated 29.07.2024 in OA No. 2917/2024.

In view of this, the present OA is disposed of at admission stage itself with direction to the respondents to take their own decision as mentioned

in order dated 28.03.2025 to its logical conclusion and pass a detailed reasoned and speaking order within a period of eight weeks from the date of receipt of certified copy of this order.

We make it emphatically clear that we have not examined or expressed any opinion in respect of merits of the case.

The OA is disposed of in the above manner. Pending MA also stands disposed of accordingly. No order as to costs.
