Mr. Sachin Dogra, learned counsel for the petitioner submits that he has filed the present petition under Article 227 of the Constitution of India because of the non consideration of the case titled "Bhan Singh vs. Suram Chand", though the matter is listed before the Appellate Court today. He seeks permission of this Court to withdraw the instant petition provided the Appellate Court is directed to consider the aforesaid matter today itself.
Accordingly, this petition is dismissed as withdrawn along with connected CM provided the Appellate Court, i.e., Additional District Judge, Jammu consider and decide the matter in case titled "Bhan Singh vs. Suram Chand" positively today, provided the pleadings are completed. In the event the matter could not be considered today, the Appellate Court shall fix a shorter date, preferably within 10 days and dispose of the same strictly under rules.
