Judgment

Heard the parties.
The learned counsel for the respondents raises a preliminary objection that the present OA is not maintainable and barred by principles of res judicata as applicant had earlier filed OA No 283/2026 and this Tribunal was pleased to dispose of the same by directing the respondents to consider the claim of the applicant by passing a reasoned order.
The learned counsel for the applicant faced with the preliminary objection regarding maintainability of the present OA seeks permission to withdraw the present OA with liberty to avail appropriate remedy in accordance with law.
In view whereof, the present OA stands dismissed as withdrawn with the aforesaid liberty to avail appropriate remedy in accordance with law.
However, there shall be no order as to costs.
