Judgment
Sabina, J.—This petition has been filed u/s 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No. 235 dated 25.10.2002, u/s 61 of the Excise Act, 1914 and under Sections 207, 177 of the Motor Vehicle Act registered at Police Station Hoshiarpur.
At the time of issuance of notice of motion on 1.11.2010, the following order was passed:
Learned Counsel for the Petitioner has submitted that due to inadvertence, the Petitioner could not appear before the trial Court on 13.5.2010 as he had noted down the wrong date.
Notice of motion for 6.12.2010.
In the meantime, the Petitioner is directed to surrender before the trial Court and the trial Court shall release the Petitioner on interim bail subject to its satisfaction.
Learned Counsel for the Petitioner has submitted that in terms of the above order, the Petitioner has surrendered before the trial Court and has furnished interim bail. Learned State counsel, on instructions from ASI Mohinder Singh, has not disputed the said fact.
Accordingly, the interim bail furnished by the Petitioner before the trial Court, in terms of order reproduced above, is made absolute.
Petition stands disposed of accordingly.
