Judgment
ORDER
By Justice Om Prakash VII, Member (J):-
Heard Shri Jaswant Singh, learned counsel for the petitioner, and Shri Mahendra Prasad Mishra, learned counsel for the respondents.
At the very outset, learned counsel for the respondents submitted that direction given in the OA has been complied with as the Department has granted the 3rd Financial upgradation as well as Non-functional Grade of Rs.5400/- we.f. 06.12.2016 in favour of the original employee and in this regard, compliance affidavit has been filed on 19.08.2026. Thus, the proceedings of the present contempt petition may be closed and notices be discharged.
Learned counsel for the applicant does not object the said submissions of the learned counsel for the respondents.
We have heard the rival submissions and gone through the entire records.
In view of the above submissions and statements made by the learned counsel for the parties, it appears that the order of this Tribunal passed in O.A. No.143/2024 has already been complied with. Thus, the proceedings of the present Contempt Petition are closed and the notices stand discharged. However, liberty is reserved to the petitioner to approach this Tribunal in case the direction passed in aforesaid Original Application is not complied with and in that case, the proceedings will be revived. All the associated M.A.s also stand disposed of.
