Judgment
Hon’ble Mr. R.N. Singh, Member (J):
The present Contempt Petition has been filed by the petitioner alleging wilful defiance of the directions of this Tribunal in Order/Judgment dated 6.2.2020 passed in the aforesaid OA. The operative part of the said Order/Judgment dated 6.2.2020 reads as under:-
“16.In view of foregoing, this OA is allowed with directions to respondents to grant the applicant temporary as well as regular status with effect from respective dates, with all consequential reliefs, including notional pay fixation as has been granted to her junior Ms. Anjali Pal, within a period of 03 months of receipt of a certified copy of this order under advice to the applicant. However, payment of arrears shall remain limited to the period from 01.04.2018 onwards only when this OA was filed. Further, these arrears will not carry any interest. No costs.”
Pursuant to the notice from this Tribunal, the respondents have filed the compliance affidavit. In the compliance affidavit, the respondents have also annexed a copy of order dated 7.4.2021. With the assistance of the said compliance affidavit, Shri Amit Anand, learned counsel for the respondents under instructions submits that pursuant to the directions of this Tribunal, temporary status has already been granted to the petitioner and arrears of pay, pay fixation and payment of difference of pay have also been calculated. He further submits that with regard to grant of regular status, the issue is under consideration. He further adds that necessary order for grant of regular status to the petitioner shall be issued and the payment of arrears shall be made to the petitioner positively within three weeks from today.
In view of the aforesaid, the present CP is closed. Notices are discharged. However, the petitioner shall be at liberty to approach this Tribunal for revival of the present CP by way of Misc. Application, if the respondents do not fulfil their own commitments as noted hereinabove.
