Judgment
Jasjit Singh Bedi, J
The prayer in the present petition under Section 528 BNSS, 2023 is for issuance of directions to the respondent nos.1 & 2 to constitute a special medical board to re-examine the injuries suffered by the petitioner in case FIR No.0215 dated 11.09.2024 under Sections 118(1), 351(2) of BNS Act, 2023 P.S. Tanda and further for issuance of directions to the respondent nos.5 to take strict departmental action against respondent nos.6 & 7.
On 13.12.2024 the following order was passed:-
" Petitioner Sukhwinder Kaur has filed petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for issuance of direction to respondents No. 1 and 2 to constitute special medical board to re-examine injuries suffered by petitioner in case FIR No. 0215 dated 11.09.2024, under Section 118(1), 351(2) of Bharatiya Nyaya Sanhita, 2023, registered at Police Station Tanda, with prayer for issuance of directions to respondents No. 5 to take strict departmental action against respondents No. 6 and 7 for not adding offence under Section 109 of Bharatiya Nyaya Sanhita, 2023 (307 IPC earlier) in case FIR No. 0215 dated 11.09.2024 under Section 118(1), 351(2) of Bharatiya Nyaya Sanhita, 2023, registered at Police Station Tanda. Further prayer is also for issuance of directions to respondents No. 3 and 4 to take strict departmental action against respondents No. 8 to 10 for giving incomplete MLR and giving wrong opinion of injuries suffered by petitioner in FIR No. 215 dated 11.09.2024 (supra).

On asking of this Court, Mr. Kewal Singh, Addl. A.G. Punjab accepts notice on behalf of State and prays for an adjournment to file status report.
Adjourned to 23.01.2025, for filing status report."
Thereafter the matter was adjourned and on 25.08.2025 the following order was passed:-
" The Petitioner is directed to appear before the Investigating Officer of the case who shall produce her before the CMO, Civil Hospital, Jalandhar on 22.08.2025.
The CMO, Civil Hospital, Jalandhar shall constitute a board of doctors to examine the petitioner to opine as to the nature of the injury on the back of the petitioner.
The report in that regard be submitted to this Court on or before 12.09.2025."
On 27.08.2025 the following order was passed:-
" CRM-34150-2025
The prayer in the application under Section 528 of BNSS is for correcting the date of appearance before CMO, Civil Hospital Jalandhar as 29.08.2025 instead of 22.08.2025 in order dated 25.08.2025.
Heard.
For the reasons stated in the application, the same is allowed and date to appear before the CMO, Civil Hospital, Jalandhar be read as 29.08.2025 instead of 22.08.2025.
The application stands disposed of."
In deference to the aforementioned orders, the petitioner was examined by the CMO, Civil Hospital, Jalandhar and it has been found that injuries suffered by her are grievous. Therefore, Section 118(2) of BNS has been invoked.
In view of the above, no further orders are required to be passed by this Court.
