Judgment
This Original Application has been registered in exercise of suo-moto jurisdiction under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) on a letter petition dated 04.09.2023, sent by Sh. Sukhvinder Singh, R/o 5450/1, MHC, Manimajra, Sector 13, Chandigarh, complaining that in May 2023, there were unprecedented heavy rains which resulted in overflow at Sukhna Lake, Chandigarh causing uprooting of more than 60 trees alongside the walking lane, but no steps have been taken by the concerned authorities for restoration of greenery and area concerned and that is how environment is being damaged.
In our view, the complaint made in this Original Application, at the first instance, can be looked into by local administration and, therefore, we direct Commissioner, Municipal Corporation, Chandigarh to take appropriate steps for restoration of green area by taking steps for requisite plantation (including transplantation) in consultation with the concerned Divisional Forest Officer, Chandigarh expeditiously, and in any case within three months from the date of communication of this order.
Compliance Report shall be submitted to Registrar General of this Tribunal by Municipal Commissioner, Chandigarh within 15 days after expiry of three months, as directed above, and Registrar, if finds necessary, shall place the matter before the Bench for further orders.
With the above directions, this Original Application is disposed of.
