Judgment
This is a letter petition registered as original application under Section 14 and 15 of the National Green Tribunal Act, 2010 (hereinafter referred to as “NGT Act, 2010).
Applicant has prayed that direction be issued for registration of First Information Report by the concerned Police Authorities but this prayer is misconceived since no such power is vested with this Tribunal. An application under Section 156(3) Cr.PC lies before Magistrate concerned.
However, having gone through the letter petition in question, we find that real grievance is alleged illegal cutting of trees in Govt. Boys Senior Secondary School, Zero Pusta Brahmpuri, Delhi-110053, without permission of competent authority. In respect thereto, it is also said that a complaint was made by one Dinesh Singh Malik, General Secretary, Vishwa Bandhu Seva Sansthan, Delhi to Principal Secretary (Environment & Forest), Environment Department, Delhi Secretariat, Delhi vide letter dated 22.04.2022 but nothing has been done.
Considering the facts and circumstances of the matter, in our view, let this matter may be examined at the first instance by Divisional Forest Officer, North East, Delhi and District Magistrate, North East, Delhi who shall take appropriate remedial action, following due process of law if complaint is found correct. With this direction, application is disposed of.
