Judgment
Sanjay Karol, J.—Petitioners submit that their cases are squarely covered by judgments rendered by this Court in CWP No.492 of 1997, titled Kailash Gupta & Others vs. The Secretary (Education) & Others, LPA No.37 of 2004 titled The State of Himachal Pradesh v. Kailash Gupta and others and CWP No.970/2005 titled Shri Balkar Singh and others v. State of H.P. & Ors. Private-respondents have not filed any reply to the instant petitions and from the reply filed by State, it is not clear as to whether any grant at + 2 level is being released to the schools or as to whether petitioners are entitled to the same.
In this background, as prayed for, liberty is granted to petitioners to approach the respondents/competent authority clearly making out their case for entitlement of the grant-in-aid, in accordance with law. Needless to add, while taking decision thereupon, respondents shall take into account the ratio of law laid down by this Court in the above mentioned petitions.
With the aforesaid observations, present petitions are disposed of, so also the pending applications, if any. Copy Dasti.
