Judgment
Justice Sanjay Karol, J.—Petitioner submits that her case is squarely covered by judgments rendered by this Court in CWP No. 492 of 1997, titled as Kailash Gupta & others v. The Secretary (Education) & others; LPA No. 37 of 2004, titled as The State of Himachal Pradesh v. Kailash Gupta and others; and CWP No. 970 of 2005 titled as Shri Balkar Singh and others v. State of H.P. & others. Private respondents do not intend filing any reply. From the reply filed by the State, it is not clear as to whether any grant at + 2 level is being released to the schools or as to whether petitioner is entitled to the same.
In this background, as prayed for, liberty is granted to petitioner to approach the respondents/competent authority clearly making out her case for entitlement of the grand-in-aid, in accordance with law. Needless to add, while taking decision thereupon, respondents shall take into account the ratio of law laid down by this Court in the above mentioned petitions.
With the aforesaid observations, present petition is disposed of, so also the pending application(s), if any.
