Judgment
This is an application to extend the time granted for curing the defects.
The facts of the case are that the Applicant filed the Interlocutory Application (IA) on 05.12.2022 and the Office after scrutiny of the IA, intimated the defects to the Applicant on the same day and returned the IA to the Applicant on 06.12.2022. The Applicant re-filed the IA on 14.12.2022. It is stated in the Interlocutory Application (IA) that all the defects were duly cured within a period of 07 days, however, one objection/Defect No.3 regarding both sides printing could only be cured after mentioning before the Hon’ble Chairperson on 13.12.2022. Hence, there is delay of 02 days in re-filing the IA, so the same may be condoned.
Heard learned Counsel appearing for the Applicant and perused the averments made in the IA as well as Office report.
Considering the submissions made on behalf of the Applicant and for the reasons mentioned in the IA, which are sufficient, the delay in refiling the IA is hereby condoned.
With the aforesaid order, this IA stands disposed of.
