ORDER
AR for IRP is present and seeks the cost which is required to be paid to the IRP as per the direction of this Tribunal stands delayed by the Operational Creditor while in the process of CIRP and in the circumstances seeks for exclusion of the period under the CIRP. However, we find that this Application has been filed prematurely under Section 12 (3) of IBC, 2016. A period of 180 days has been provided for the CIRP and in addition 90 days period has also been provided with a power to extend another 70 days by virtue of the recent amendment made effective from 17.08.2019, In the circumstances, if necessary let the IRP / RP can move the Application at the time of expiry of 180 days seeking for extension / exclusion of the period in relation to the CIRP. With the above direction, this Application stands closed.
