Judgment
ORDER
This is an application filed by the Operational Creditor seeking a substitution of the appointment of the IRP as erstwhile IRP appointed by the Bench has intimated the IBBI on 05.12.2019 that he is surrendering his License as he has been appointed as CFO in DHFL Company.
The order of admission was passed on 14.11.2019.
The Bench notes that the Operational Creditor has not been taken any steps to reappoint the IRP or any substitution till date, despite being aware of the fact that the IRP appointed has chosen to surrender his license.
However, it is also pointed out that the Operational Creditor was undergoing CIRP vide an order of admission on 31.08.2020. The CIRP further was set aside under section 12A of the Code on 22.07.2021.
This application is now filed seeking an appointment of Mr. Jatin Mehra having Registration No. IBBI/IPA-001/IP-P-02010/2020-2021/13103, IRP in the matter and the Form 2 (consent form) has been filed.
The Bench approves the appointment of Mr. Jatin Mehra as the IRP in the said matter and directs the IRP to complete the CIRP in the time bound manner.
The IA(I.B.C)/3001(M B)2021 is allowed and disposed of and the time period from 14.11.2019 to 03.01.2022 is excluded from the CIRP and it is ordered that it is just & necessary that the CIRP would commence from 03.01.2022.
