This matter is taken up by virtual mode.

Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is stated to have completed the construction work of the J.M.F.C. Court building at Kotpad before the stipulated date and it is

submitted that the petitioner is entitled to the incentive as per Clause-4.2.1 of the OPWD Code. The Executive Engineer concerned is also stated to

have recommended the case of the petitioner for incentive vide Annexure- 4 to the Chief Engineer (Buildings), Odisha, Bhubaneswar. Now, the

matter is stated to be pending before the Chief Engineer (Buildings). Though the recommendation has been made since 2019 by the Superintending

Engineer Jeypore (R&B) Circle, no action has yet been taken by the Chief Engineer (Building)-Opposite Party No.4.

Regard being had to the facts and submissions and the nature of relief sought for, the writ application is disposed of directing the petitioner to file an

application before the Chief Engineer (Buildings), Odisha, Bhubaneswar-Opposite Party No.4, within a period of two weeks from today. If such an

application is filed, the same shall be disposed of on the basis of Annexure- 4, within a period of two months from the date of its filing, by passing a

reasoned order.

The writ application is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order

available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide

Court’s Notice No.4587 dated 25th March, 2020 as modified by Court’s Notice No.4798 dated 15th April, 2021.
